General Terms & Conditions of Business
When you place an order either verbally over the telephone, via email or over the internet, you enter into a legally binding contract with Premier Party Hire (hereinafter referred to as “Premier Soft Play”). In the interests of protecting both parties, that contract is governed by the General Terms & Conditions of Business (“Terms & Conditions”) set out below. By placing an order, you are accepting these Terms & Conditions without reservation.
If, for any reason, we cannot accept your booking we will advise in writing by email and refund any monies paid. All bookings are subject to our approval and acceptance. Email confirmations will be sent within 48 hours of receiving your booking.
TERMS & CONDITIONS OF BUSINESS
DEFINITIONS
The “Customer” refers to the person(s), organisation or company booking the equipment with Premier Party Hire.
The “Equipment” refers to all items and accompanying accessories hired or supplied by Premier Party Hire to the Customer.
The “Booking” refers to the Equipment owned or contracted by Premier Party Hire that is reserved/supplied for use by the Customer on a specific date(s).
BOOKINGS
1.1 By placing a Booking with Premier Party Hire either verbally or in writing, including email or online, it is deemed that the Client has thoroughly read, understood, fully agreed to and is bound by the ‘Terms & Conditions of Business’, including the cancellation policy.
1.2 If traffic or any other circumstances beyond the control of premier Party Hire prevent it from being able to fulfil the booking in its entirety, our liability shall be limited to a refund of any monies paid. No further compensation will be paid irrespective of the circumstances.
1.3 If, for reasons beyond the control of Premier Party Hire, Equipment is not set up for the start time of a party or event, Premier Soft Play shall endeavour to make up the hire period by collecting the Equipment later to compensate for any loss of hire time where reasonable. No refund will be offered for loss of hire time unless Premier Party Hire was clearly at fault; in this case, the refund is limited to a maximum of 50% of the total hire fee on a pro rota basis.
PRICES, DEPOSIT AND BALANCE PAYMENTS
2.1 All Bookings are subject to a non-refundable deposit based on our Deposit Policy. The deposit will be deducted from the final booking fee.
2.2 Advertised prices are subject to change without prior notification.
2.3 Booking fees include setting up and taking down the equipment within the periods specified on the Booking Confirmation
2.4 If the payment is not made on time, Premier Party Hire reserves the right to cancel, suspend or add interest to any outstanding payments. Payments with added interest will be added to the invoiced amount and will be increased over the period for which the Customer is in default. A debt recovery cost of £50 will be added on top of an 8.5% interest rate (based on 0.5% base rate of the Bank of England, February 2019).
CANCELLATIONS
3.1 Any cancelled booking is subject to this cancellation policy.
3.2 Premier Party Hire reserves the right to cancel outdoor Bookings if the wind speed, including gusts, are forecast to exceed 24mph. The Customer will be able to transfer the Booking Fee to another date up to 1 year in advance or can request a refund of the deposit.
3.3 Premier Party Hire will charge the Customer 100% of the booking fee if the items hired will not fit in the area provided. Any replacement items, if available, will be charged as per the advertised prices on the website and will not be supplied until the fee for the original items is paid.
3.4 Premier Party Hire will accept cancellation of a Booking up to 12noon the day before the hire date. The deposit and any monies paid to Premier Party Hire will not be refunded. In the case of cancellation after 12noon the day before the hire, the Customer shall be liable for 100% of the booking value within 7 days. Exceptions will be made at the discretion of Premier Party Hire if cancellation is due to adverse weather or there are other extenuating circumstances.
EQUIPMENT
4.1 All Equipment supplied by Premier Party Hire remains the property of Premier Party Hire and Inflatables.
4.2 Premier Party Hire reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment/items.
4.3 All sizes quoted are approximate.
4.4 It is the responsibility of the Customer to ensure that the Equipment is fully supervised by a responsible adult at all times.
4.5 The Customer or their representative must read and sign the Terms & Conditions of Hire, which gives rules regarding the safe use of the Equipment, as provided with the Booking Confirmation and/or at time of set up of the Equipment.
4.6 The Customer is responsible for the Equipment during the hire period. Any loss or damage will result in the Client being invoiced for the full replacement value or repair of the item(s). Premier Party Hire will also have the right to claim reasonable compensation for loss of earnings while waiting for a repair or replacement item. Any loss or malicious damage must be reported to the police and an incident number logged if the Customer wishes to make a claim via an insurance company.
4.7 All Equipment must be used in accordance with Premier Party Hire Terms & Condition of Hire
SITE LOCATION, FACILITIES AND CONDUCT
5.1 Please ensure the area provided offers sufficient space and suitability as per the dimensions and descriptions stated on the Premier Party Hire website.
5.2 The Customer is responsible for ensuring that adequate and safe 240V AC mains supply is available on delivery and throughout the hire period. Premier Party Hire cannot be held liable for power cuts/loss of power. No compensation will be paid for loss of use due to power failure.
5.3 Premier Party Hire reserves the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the Customer has failed to notify Premier Party Hire of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the set up site. In such cases, no refund will be given and 100% of the hire fee will be due within 7 days.
5.4 Premier Party Hire reserves the right to cease operation and remove hired equipment from site if at any time a representative of Premier Party Hire feels that the conduct of the Customer or their guests endangers the safety of users of the Equipment or the safety of the Equipment. In such cases, no refund will be given.
Delivery/Access
Delivery of bouncy castles usually requires external access measuring at least 4ft in width. If any items of soft play, light up numbers, bouncy castles or any other equipment have to be carried through the property because appropriate external access is not available, this is solely at the customer’s risk. While we will exercise due care, Premier Party Hire cannot accept liability for any accidental damage caused as a result of limited access (i.e. no external access measuring at least 4ft in width).
LIABILITY AND INSURANCE
6.1 Premier Party Hire holds Public Liability Insurance and can provide a copy of the insurance certificate at the Customer’s request.
6.2 The Customer hereby agrees to indemnify Premier Party Hire for any damage or theft of equipment whilst on hire.
6.3 Premier Party Hire accepts no liability for any damage or loss of personal property and/or any injury arising from the use of the hired Equipment.
MISCELLANEOUS TERMS
7.1 If any provision of these terms is unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.
REFUNDS
8.1 Refunds will be limited to 50% of the total Booking value, excluding delivery charges, unless Premier Party Hire have failed to deliver the Equipment in their entirety for the duration of the hire period.
8.2 If Premier Party Hire fail to deliver the Equipment in its entirety, for the full duration of the hire times or event, where the Customer or their representatives are not at fault, Premier Party Hire will refund the Client 100% of the Booking value. No compensation will be provided.
8.3 Any agreed refunds will be issued within 30 days of the hire date.
COMPLAINTS
9.1 In the unlikely event that you are unhappy with any aspect of our equipment or services, please make the delivery team aware on the day of your hire and put your complaint in writing by sending n email to info@premiersoftplay.co.uk We will acknowledge and deal with your complaint within 2 working days.
